complainant Sh. Shiv Prasad Dubey.
Fresh complaint received by way of assignment. It be checked and registered as
per rules.
Ld. Counsel for the complainant has filed the original complaint alongwith
documents today. The same has been confirmed by the Reader of this court. Be taken on record.
In light of the judgment tiled as ‘Sanjabij Tari Vs Kishore S. Borkar & Anr.’ Crl.
Appeal no. 1755 of 2010 passed by the Hon’ble Supreme Court on 25/09/2025, the requirement
of issuing notice u/s 223 of the BNSS and hearing the proposed accused on arguments on
cognizance is dispensed with.
Perusal of record reveals that the authority letter in favour of Sh. Shiv Prasad Dubey
authorising him to pursue the present legal proceedings has not been filed on record.
Ld. counsel for the complainant submits that the present case has been filed
against one Varun Vashisht, however, the name of the accused as reflected on the CIS Server
is Virender Kumar. Reader/Ahlmad are directed to make the necessary changes.
Put up for filing of requisite documents/arguments on cognizance on 27.02.2026.
