Proceedings are being conducted through hybrid mode.
Present: Mr. D.N. Chaturvedi, Ld. Counsel for the applicant/
complainant along with complainant in person.
Enquiry Officer SI Priyank Rana in person.
Previous Enquiry Officer SI Nishant also present in
person.
The matter is listed for filing of conclusive ATR.
However, it is noted with concern that the ATR has admittedly not been
filed even today.
It is observed that the first direction for filing of ATR was
issued by this Court on 24.10.2024, requiring compliance by
17.01.2025. The same remained uncomplied with, and the matter was
adjourned to 04.04.2025. Even on the said date, the conclusive ATR was
not filed, and a further opportunity was granted with directions for
compliance today.
Despite repeated directions, no conclusive report has been
filed, indicating a lack of due diligence and compliance by the official
concerned. Such non-compliance cannot be permitted to stall the
progress of the proceedings.
In the circumstances, and with the consent of the Ld.
Counsel, submissions on the application under Section 175 of BNSS
have been partly heard.
At request, the matter is adjourned for remaining
submissions on 01.09.2025.
Let a copy of this order be sent to the SHO concerned for
information and appropriate action. The order be uploaded as per rules.
