Part arguments on the aforesaid application heard.
It is the submission of counsel for the complainant that
forceful abortion of the wife of complainant namely Ashma was done by
accused persons. However, a perusal of the ATR and the statements
annexed with it show that the statement of Mrs. Aasma has not been
recorded by the EO. When the offence is alleged to have taken place
against Mrs. Aasma, EO has to record her statement.
In view of the above, the EO/Concerned SHO is directed to
record the statement of Mrs. Aasma. Further, let the EO also be
summoned to appear physically on the next date of hearing alongwith the
fresh ATR.
Matter be re-listed for further proceedings on 11.05.2026.
