Counsel for the injured. The matter is listed today for consideration/arguments on the point of cognizance and for consideration of the application under Section 193 BNSS moved on behalf of the injured. The de facto complainant is absent. During the course of submissions, it was submitted that the application under Section 193 BNSS may be treated as an application under Section 230 BNSS. The Court has queried the Ld. Counsel as to how such application is maintainable at this stage, when the Court has not yet taken cognizance or summoned the accused. Ld. Counsel seeks time to address the issue and advance submissions. The request is not opposed by the State. Heard. Allowed in the interest of justice. In the meantime, let notice be issued to the Investigating Officer SI Priyank Rana to remain present physically on the next date of hearing without fail. In case the said Investigating Officer is unavailable, the SHO concerned shall remain present in person. Let a copy of this order be sent to the SHO concerned for information and compliance.
