Injured Sughad Singh is in person.
The matter is listed for consideration/arguments on the
point of cognizance and appearance of the Investigating Officer.
At this stage, a request has been received from the
Investigating Officer seeking exemption on the ground that he has to
appear before the Hon’ble High Court of Delhi. Ld. APP is on leave
and no substitute is present as he is engaged in his regular court.
An application under Section 193 BNSS has been moved
on behalf of the injured/victim Sughad Singh Yadav seeking (i) supply
of chargesheet and supplementary chargesheet, (ii) details of the
offending vehicle, driver, owner, and insurance company, and (iii)
initiation of disciplinary action against the Investigating Officer. The
same be taken on record.
Notice of this application be issued to the State.
During the dictation of this order, Mr. Shyam Babu, Ld.
Counsel for the applicant/injured Sughad Singh Yadav, has appeared
through VC. He has been apprised of the order and today’s
proceedings.
Let the matter be put up for consideration of the
application as well as for submissions on the point of cognizance on
04.11.2025. Let a copy of the application be supplied by the applicant
during the course of the day so that it may be forwarded to the SHO
concerned. Copy of this order be sent to the SHO concerned. The
order be uploaded as per rules.
