The matter is listed for consideration / arguments on
the point of cognizance as well as submissions on the point of
maintainability of the application under Section 193 BNSS /
Section 230 BNSS.
Despite service, the Investigating Officer has
remained absent. None is present on behalf of the State.
It is noted that this Court had earlier directed that in
case of absence of the Investigating Officer, the SHO concerned
shall appear. However, neither the IO nor the SHO is present
today.
In these circumstances, while refraining from
passing any adverse order at this stage, notice be issued to the
Investigating Officer.
