not present in Delhi at the time of incident and there is no CCTV footage or
independent witness of the incident. He further argued that there is no
injury to the complainant as per MLC and thus prays that accused persons
be discharged.
It is settled law that the plea of alibi or the availaibility of
independent witness can be tested at the stage of trial and a mini trial
cannot be conducted at this stage of framing of charge.
From the material available on record,
prima facie offences
under section U/s 323/341/34/506Part-II/509 IPC are made out against both
the accused persons. Separate charges U/s 323/341/34/506Part-II/509 IPC
framed upon both the accused persons. Both the accused persons pleaded
not guilty and claims trial.
