Court as per order no. 4/7/RG/DHC/2020 dated 27.08.2020.

Fresh complaint received by way of assignment. It be checked and registered as
per rules.
In light of the judgment tiled as ‘Sanjabij Tari Vs Kishore S. Borkar & Anr.’ Crl.
Appeal no. 1755 of 2010 passed by the Hon’ble Supreme Court on 25/09/2025, the
requirement of issuing notice u/s 223 of the BNSS is dispensed with.
Matter is at the stage of consideration.
Upon consideration of the record it is revealed that in the present case the
cheque that has been annexed along with the complaint has been signed by one Sh. Rajesh
Kaushik and the number of the cheque in question is 000080 for Rs. 1,89,398/-. Whereas the
complaint has been filed against Ms. Urmila Yadav and the notice u/s 138(b) NI Act has been
issued to Ms. Urmila Yadav and Ramesh Yadav thereby demanding a sum of Rs. 2,67,000/-, as
such there is anomaly in the record.
Accordingly, Ld. Counsel for complainant is directed to address the aforesaid
anomaly in the record for NDOH.
