Order Details: COPY OF JUDICIAL PROCEEDINGS Pdf Text: 5Cr. Case15095/2024 State Vs. Sukhbir FIR No. 500/2023 PS (Darya Ganj) 30.07.2026 Proceedings are being conducted through hybrid mode. Present: Mr. Manish Bansal, Ld. Substitute APP for the State. Report already filed by SHO in compliance of order dt. 09.06.2025 perused. Submissions heard on behalf of the State. Record perused. It is observed that Ld. Predecessor has raised the query to the State regarding the role of Babli in the present matter who used the stolen mobile phone for the considerable period of time using her SIM, however, the chargesheet is specifically mentions that the said Babli had used the stolen mobile phone after purchasing the same from her neighbour Nikhil i.e the son of accused Sukhbir and she returned the mobile phone to him when he did not provide the bill for the same. I am of the opinion that accused Babli might not have the knowledge about the phone being stolen since she returned the mobile phone since the bill of the mobile phone was not provided to her. She appears to be a bonafide retainer of the stolen property and may not be summoned as an additional accused in the present matter. I take cognizance of the offence mentioned in the chargesheet punishable under section 379/34/411 IPC. I am of the opinion that prima facie case is made out against accused Sukhbir to be proceeded further. Let accused Sukhbir be summoned for the NDOH though SHO PS concerned.
