Accused is absent.
NBWs issued against accused received back unexecuted. Perused.
It seems that accused is deliberately avoiding his arrest in the present case.
In view of above, I deem it appropriate to direct issuance of proceedings under
Section 82 Cr.P.C. against accused.
Accordingly, issue process under Section 82 Cr.P.C. against accused, at all
available addresses, returnable for NDOH. The process be executed :
(i) By publicly reading the proclamation in conspicuous place of town or
village in which accused ordinarily resides;
(ii) By way of affixation in conspicuous part of the house or homestead in
which accused ordinarily resides or to some conspicuous place of such
town or village;
(iii) By way of affixation in some conspicuous part of the Court.
(iv) By way of publication in local newspapers (English and Hindi/local
language) where accused last resided. In case the publication is made in
local language other than Hindi, the transcription of the same in Hindi
language be annexed with the report.
The process be directed to be executed at least 30 days before the NDOH fixed in
the matter and concerned Process Server be directed to appear on NDOH.
