Adjournment has been sought on behalf of the complainant on the ground that
the complainant is not available today due to fracture on their leg. However, it is submitted
that the fresh medical documents are not available with Ld. Proxy counsel today and the same
will be filed on the NDOH. Perusal of record reveals that report of X-ray was filed on the
LODH wherein it was stated that there was partially heeled fracture. Further, last opportunity
was granted to the complainant to lead C.E., subject to payment of cost of Rs.2,000/-.
As the medical documents are submitted today and the accused has been
diligently participating in the present proceedings, the court deems it appropriate to enhance
the previous cost of Rs.2,000/- to Rs.5,000/- to be paid to the accused. The same be paid not
later than seven days from today. Further, in light of frequent adjournments having been
sought on behalf of the complainant, and the fact that the accused has been appearing on every
date of hearing, the court exempts the accused from physical appearance till the stage of
statement of accused u/s 313 Cr.P.C. arrives. In the interest of justice and keeping in mind of
principles of fair trial, last opportunity granted to the complainant to lead C.E. is extended till
the NDOH, subject to payment of cost mentioned above.
Accused is at liberty to appear through V.C. on the NDOH.
Put up for purpose fixed on 30.09.2026.
