Matter is at the stage of consideration on present complaint. Ld. Counsel for the complainant submits that two cheques were taken as security from the proposed accused. Therefore, one cheque is blank and another cheque has been filed for the amount of Rs. 39,366/- and on basis of this cheque the present complaint has been filed. It is further submitted that one loan bond has been filed which has multiple overwritings, however, another loan bond has been filed on different page. Complaint perused. It is supported by affidavit. Cognizance taken. Perusal of file reveals that cheque(s) got presented for encashment and got returned dishonoured. Accused has failed to make payment within the statutory period despite a legal notice of demand. The Complaint is within the territorial jurisdiction of this Court and is within limitation. Enquiry under Section 202 CrPC/225 BNSS conducted by scrutinizing documents. Arguments on summoning heard. Issue Summons to Accused SHANKAR KUMAR ARYA on filing of PF through all modes within 15 days on all the addresses provided by the Complainant. Complainant shall be at liberty to accompany the process server at the time of service of summons. List for appearance of accused on 03.03.2026.
