complainant.
Complainant is absent.
Matter is at the stage of consideration on present complaint.
In terms of judgment of Hon’ble Supreme Court of India in
‘Sanjabij Tari v. Kishore S. Borcar & Anr.’, pronounced on 25.09.2025, in
Criminal Appeal No.1755/2010, requirement for issuing notice u/s 223 BNSS to
proposed accused stands dispensed with.
Perusal of record reveals that the memo of parties mentions to
incorrect name of the complainant. Ld. Counsel for complainant has filed
amended memo of parties rectifying the error. Taken on record.
Perusal of record reveals that the cheque in question has been
dishonoured for the reason ‘suspended/ block bank’. Accordingly, let witness
from complainant’s bank i.e. HDFC Bank, Shastri Nagar Branch, be summoned
for NDOH to clarify the reason of dishonour of cheque in question.
Steps for filing PF alongwith copies of cheque and return memo in
question be taken within one week from today.
