Present: Ms. Laxmi, Ld. Proxy Counsel for complainant.
None for accused.
Matter is at the stage of appearance of the accused.
An application has been filed for substitution of AR by the
complainant. Same is taken on record. Application being formal in nature is
allowed and accordingly Mr. Manish Jethi stands substituted as AR of the
complainant. Complainant is directed to file fresh evidence affidavit of the
substituted AR by NDOH with advance copy to opposite side.
Summons could not be issued due to non filing of PF.
One more opportunity is granted to the complainant to take steps for
issuance of summons against the accused on filing PF.
In the meantime, let fresh summons be issued against the accused on
filing of PF within two months, through all modes, returnable for NDOH.
Complainant is directed to file proof of service.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
In case of online service, complainant is directed to file requisite
affidavit with contact details of the accused and certificate U/s 63 BSA to show due
service through online mode.
Summons should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant side on the no. 9268632906, in view of the judgment passed by
Hon’ble Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S.
Borcar & Anr., 2025 (SC)

Put up for filing of fresh evidence affidavit/ appearance of accused/
framing of notice/ furnishing of surety/ further proceedings on 21.05.2027.
