Kishore S. Borcar & Anr., 2025 LiveLaw (SC) 952”, there shall be no requirement to issue summons to the accused in terms of Section 223 of BNSS i.e., at the pre-cognizance stage. Hence, appearance of proposed accused is hereby dispensed with. Perusal of the record shows that an application for condonation of delay has also been filed along with the case as there is delay in filing of the present matter. Submissions heard. Record perused. Let notice of aforesaid application be issued to the proposed accused on filing of PF/RC/AD for the NDOH. Service be also affected dasti as well as on the email, WhatsApp message(s) and text message of proposed accused person(s), as provided by the complainant and further subject to filing of affidavit of service.
