AR of complainant is absent.
Matter is at the stage of consideration on present complaint.
Perusal of record reveals that the drawer of cheque in question is
a proprietorship concern. As per the GST registration details of drawer of
cheque in question, filed alongwith the complaint, Sh. Arun Shah is the
proprietor of drawer of cheque in question. However, some other person has
been arrayed as accused in the present case. As per law laid down in judgment
of Hon’ble High Court of Delhi in ‘Siddharth Duggal v. State’ (12.10.2023), only
the proprietor of a proprietorship concern can be arrayed as accused in case
the drawer of cheque in question is a proprietorship concern.
Ld. Counsel for complainant seeks an adjournment to file an
amended complaint to that effect.
Since matter is at pre-cognizance stage and considering the
nature of amendment sought, request for amendment stands allowed.
Let amended complaint alongwith amended memo of parties and
fresh evidence affidavit be filed on NDOH.
Put up for purpose fixed on 05.12.2025.
