Status report filed seeking some time to conclude the inquiry as alleged
person are yet to be interrogated. Copy supplied.
One order of the Hon'ble High Court of Delhi in Crl. MC No. 2394/25
dated 07.04.2025 has been filed by the complainant stating that no such matter as stated
by the EO on the last date of hearing seeking exemption was listed on 10.11.2025 at all.
Taken on record.
Neither the IO is present today nor any explanation has come forth for his
non appearance and even no conclusive ATR has been filed.
In the given circumstances, issue B/w against the EO SI Vikas Rathi in
the sum of Rs. 5000/- with one surety in the like amount for the NDOH through
SHO concerned to appear in person and file conclusive ATR.
Let court notice be issued to the SHO concerned to appear in person in
default of IO filing conclusive report for NDOH.
At this stage, it is submitted by the Ld. Counsel that as per the mandate of
law u/s 173 (3)(1) BNSS, the EO has failed to conduct the inquiry within 14 days and
accordingly the matter may be proceed further on merits.
Heard.
In view of the submissions made, the court does not deem it fit to wait any
further, since the complainant does not wish to do so.

Accordingly, relist for arguments on the application u/s 175 (3) BNSS on
18.07.2026.
Shortest possible date is given considering the board.
