Today undersigned is working as full day link of Ld. JMFC, NI Act-07 .
Present: Sh. H. K. Torani, Ld. Counsel for complainant with complainant.
ASI Naresh Kumar, PS Sadar Bazar, No. 1957-North.
None for accused.
NBWs issued against the accused through DCP concerned received
back unexecuted with the report that shop of the accused is closed since 3-4 months.
Statement of neighbour is also annexed. Explanation has been furnished by ASI
Naresh Kumar today in court.
Perusal shows that previously accused had entered appearance in the
matter as is evident vide order dated 10.09.2024.
At this stage, complainant submits that he shall accompany the process
server as the accused is residing at the same address and is operating his shop from
the same address.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let fresh NBWs be issued against the accused proprietor through the
concerned DCP returnable on NDOH, on filing of PF within two months. DCP
concerned is directed to ensure atleast three visits/ attempts are made to execute the
process and proper report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
The complainant is at liberty to accompany the process server for
execution of warrants. Executing officer is directed to contact complainant on no.
9289501220 (Anuj Jain, Complainant).
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 28.04.2026.
