Fresh case is received by way of assignment. It be checked and registered.
Present: Ms. Kirti, Ld. Counsel for complainant.
Matter is at the stage of consideration.
Perusal shows that complainant has stated that the cheque in question
was returned on to the complainant on 20.12.2025 and 26.12.2025 but the
information about the same was received only on 07.01.2026. Thereafter legal
demand notice was sent to proposed accused on 05.02.2026 and was duly delivered
on 07.02.2026. However, present complaint has been filed beyond the period of
limitation as prescribed u/s 138 NI Act.
Ld. Counsel for complainant submits that complaint was wrongly filed
before the Ld. Rohini court and the complaint was disposed off as returned on
26.05.2026. Copy of the said order has been annexed. Copy of filing history of the
complaint wrongly filed before Ld. Rohini Court has also been annexed which
shows that complaint was filed within limitation before Ld. Rohini Court.
An application for condonation of delay is already on record. Taken on
record.
Issue notice of the application of condonation of delay to proposed
accused through all modes on filing of PF within two months returnable on NDOH.
Copy of application be also filed at the time of filing of PF to be sent
along with the notice.
Complainant is directed to supply the soft copy of application of
condonation, complaint and other documents to the proposed accused well in time.
Notice of condonation of delay should carry an endorsement that
accused is at liberty to settle the matter and pay the amount to the complainant by
reaching out the complainant on the no. 8130684321, in view of the judgment
passed by Hon’ble Supreme Court of India, in case titled as
Sanjabij Tari Vs.
Kishore S. Borcar & Anr., 2025 (SC)
