Complainant is absent.
Perusal of record reveals that present complaint has been filed for
cheque amount of Rs. 77,000/- and Rs. 1,00,000/-. Perusal of amended complaint
reflects that it has been mentioned in para no. 11 of amended complaint that as
per the ledger/statement of account filed along with amended complaint (from
01.04.2021 to 31.003.2024) of the complainant, the outstanding against the
present accused is Rs. 1,52,588/-. Perusal of the ledger/statement of account
(from 01.04.2015 to 31.03.2023) filed along with original complaint shows debit
balance of Rs. 1,62,588/- but the cheque amount in the present case is much
higher than the outstanding upon accused. Complainant is directed to clarify the
above-mentioned aspect.
Counsel holding vakalatnama for complainant and complainant
are directed to remain physically present in court on the date already fixed i.e.
27.01.2025.
