Complainant is absent.
Perusal of record reveals that present complaint has been filed for
cheque amount of Rs. 56,120/- and Rs. 75,000/-. Perusal of amended complaint
reflects that it has been mentioned in para no. 10 of amended complaint that as
per the ledger account of the complainant, the outstanding against the present
accused is Rs. 1,20,020/-. Perusal of the ledger/statement of account (from
01.04.2015 to 31.03.2023) filed along with complaint shows debit balance of Rs.
1,20,020/- but the cheque amount in the present case is much higher than the
outstanding upon accused. Complainant is directed to clarify the above-
mentioned aspect.
Counsel holding vakalatnama for complainant and complainant
are directed to remain physically present in court on the date already fixed i.e.
27.01.2025.
