No adverse order is being passed today as lawyers are abstaining from
work due to ongoing strike.
Fresh case is received by way of assignment. It be checked and registered.
Present: Complainant is present with proxy counsel, through VC.
Matter is at the stage of consideration.
Case file perused.
Perusal of record shows that the complainant has referred two
cheques in present matter. However, proxy counsel for complainant submits that
present complint is only related to one cheuqe no. 191028 i.e. cheque in question
for an amount of Rs. 1 lac only.
Let notice as per section 223 BNSS, be issued to the proposed
accused no. 1 (signatory Ankush Sethi), on filing of PF within two months,
returnable on NDOH.
Proposed accused no. 2 is alleged as the wife of proposed accused
no. 1 and is stated to be involved in present transaction. However, since she is not
the signatory to the present cheque, as per perusal, notice need not be issued.
Further, the complainant is at liberty to serve the copy of this order
to the proposed accused as notice through whatsapp, SMS, e-mail subject to the
filing of affidavit of service on e-mail or mobile number of proposed accused.
Complainant is directed to file proof of service.
Put up for arguments on summoning/consideration on 22.12.2025.
