Pdf Text: 14 CC NI ACT 9802/2024
MS NAZAR AL JANAMAZ STORE Vs. MOHD ANAS
02.04.2026
Present: Complainant in person.
Sh. Mohammad Iqbal, Ld. Counsel for complainant.
Accused in person.
None for accused.
Matter is at the stage of CE.
Matter has been received back as unsettled from mediation cell due to
absence of accused. On LDOH, it was clarified that on failure of settlement, accused
is given last opportunity to cross-examine the complainant.
Today accused has moved an application that he wishes to proceed on
case with merits. Since the settlement has failed, matter has to anyway proceed on
merits. Same was also recorded on previous order sheet. The application shows that
accused has prayed that notice u/s 251 Cr.P.C be also framed. However, the notice
has already been framed on 11.02.2025.
Today is the 3rd date that accused has failed to cross-examine the
complainant. It is pertinent to mention that accused has himself moved an
application to proceed with the case on merits but he has failed to cross-examine the
complainant. Complainant has appeared today. Accordingly, court is not inclined to
give any further opportunity to accused to cross-examine the complainant and his
right for the same stands closed.
The statement of the accused has been recorded u/s 313 Cr.P.C as per
which the accused has expressed his desire to lead evidence.
The accused is directed to file the list of witnesses before the next date
of hearing with an advance copy to the Ld. Counsel for the complainant atleast 5
days before the NDOH on the no. 9873058495.
Parties are at liberty to explore possibility of settlement out of court on
the no. mentioned above.
Put up for DE/settlement if any on 12.08.2026.
