Counsel for complainant.
Ld. counsel submits that the land allegedly purchased by
the complainant for land development, construction of a residential
purpose was used for the construction of a resort without his consent.
Moreover, a liability of Rs.2 crore was also imputed upon him as per
Annexure A10 wherein it has been stated that the applicant, as a
continuing member shall pay Rs.2 crore to Mr. Rajan Bhardwaj and
others. It was also alleged by the applicant that the proposed accused
persons entered into a partnership namely M/s Avenue 18 Hospitality
and transferred the possession of the land in the name of the firm.
Perusal of Annexure A10 reflects that it has not been
signed by the applicant Mr.Vinay, however, he has been cited as a
continuing partner without his consent. No amount / profit share has
been received by the applicant.
Ld. counsel submits that the applicant was deceived into
purchasing the land in question. However, he was devoid of the profits
of the same by the collusive acts of the proposed accused persons.
Let notice be issued to IO /SI Narnder to file a fresh ATR
after probing the said factual matrix from the lens of criminal law. Let
copy of this ordersheet be tagged along with notice.
Put up for filing of conclusive ATR on 26.11.2025.
