Present: Sh. Bhupender Sharma, Ld. Counsel for complainant (through VC).
None for accused proprietor.
BWs issued against the accused received back unexecuted with the
report that one person namely Rajan Kumar was found who stated accused has not
been coming to his shop since past 5-6 months another person namely Akash Kumar
was found who stated that accused seldom comes at shop and he has no information
about his whereabouts. Statement of both the witnesses along with photographs have
been annexed. As per the report, even the phone number of the accused could not be
reached. Proper detailed report for the same has been placed on record.
Previously summons have been received as delivered upon accused
which is evident vide order dated 17.12.2024. Ld. Counsel for complainant submits
that there is no other address of the accused. Even the GST details of the accused
which are on record mentions the same address details as on the memo of parties.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused through the concerned DCP
returnable on NDOH, on filing of PF within two months. DCP concerned is directed
to ensure atleast three visits/ attempts are made to execute the process and proper
report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 25.11.2026.
