Present: None for complainant.
None for accused proprietor.
Complainant has failed to furnish custody details of the accused.
On LDOH, in alternate, summons were directed to be issued against
the accused. Complainant has failed to file PF for compliance. Today also, none has
appeared on behalf of the complainant.
Previously also, on 29.01.2025, last and final opportunity was granted
to the complainant to pursue the matter.
Steps have not been taken by the complainant.
In the interest of justice, one more last and final opportunity is granted
to the complainant to pursue the matter and to furnish custody details of the accused.
Said opportunity is allowed subject to cost of Rs. 500/- to be paid to NGO on the
UPI id: earthlingstrust99.rzp@icici. Receipt of same be filed by NDOH.
PAYMENT OF COST IS PRE REQUISITE.
In alternate, issue fresh summons to the accused on filing of PF within
two months through all modes returnable for NDOH.
In case of online service, complainant is directed to file requisite
affidavit with contact details of the accused and certificate U/s 63 BSA to show due
service through online mode.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Complainant is directed to positively file the proof of service on
NDOH.
The complainant is also directed to file the GST details of accused
proprietor.
Put up for filing of GST/custody details/ appearance of accused/
framing of notice/ furnishing of surety/ further proceedings on 17.03.2027.
