Interim report filed by the Court Receiver stating that the
physical possession of the secured asset could not be taken in terms of
order dt.14.08.2026, as for sometime, settlement talks were underway
between the parties and the borrower had paid some amount to the
Financial Institution. The proceedings were accordingly, deferred at
request of the AR of the Financial Institution. However, the settlement
talks have now seemingly failed, as the borrower has not paid the
further sum to the Financial Institution and there is no contact with
him. The Financial Institution seeks fresh directions for taking the
physical possession of the secured asset, as informed by the Ld. Court
Receiver.
The Ld. Court Receiver is directed to take fresh steps in
terms of order dt.14.08.2026 and file his report on 07.12.2026.
Copy of this order be given dasti to Ld. Court Receiver.
