Present: Sh. S. S. Tripathi, Ld. Counsel for complainant through VC.
None for accused.
Matter is at the stage of furnishing of fresh address since 30.05.2024.
Thereafter, today is the 4th date that the same has not been furnished by the
complainant. Various last and final opportunities have been repeatedly given to the
complainant to trace out the fresh address. Even a cost of Rs. 500/- was imposed on
the complainant on 11.03.2025. Same has also not been deposited. On LDOH, a
caution was given that on non-compliance of previous order, matter shall be
dismissed for non-prosecution.
Perusal of the record reveals that the conduct of the complainant qua
the proceedings has been lackadaisical. It seems that complainant is not interested in
prosecuting the matter. However still by way of abundant caution. Matter be
awaited for post lunch session before any adverse order is passed.

Present: None for the complainant.
The complainant has not appeared despite repeated calls. It is clear that
the complainant is not interested in prosecuting the present complaint and in these
circumstances - no fruitful purpose would be served by keeping the matter pending.
Complaint is, therefore, dismissed for non prosecution and non appearance.
The accused stands acquitted.
Surety stands discharged.
File be consigned to Record Room after due compliance.
