Order Details: COPY OF ORDER Pdf Text: 16 Ct. Cases No.1387/2024 Aditya Saboo And Arvind Saboo Vs. Unknown 16.04.2025 Proceedings are being conducted through hybrid mode. The undersigned is working as Second Link JMFC to Ld. CJM (Central) and also First Link of Ms. Preeti, Ld. JMFC, Central for full day. Present: Complainants in person along with Mr. Bharat Gupta, Ld. Counsel. The matter is listed for filing of Action Taken Report (ATR) in terms of the order dated 22.08.2024. However, ATR has not been filed. Instead, a request letter has been received from SI Piyush Tomar stating that further enquiry has been marked to him and he needs more time. It is noted with concern that the said request has not been forwarded through the SHO concerned, despite previous specific directions of this court that all communication and reports must be routed through the SHO. Further, it is observed that one opportunity was already granted vide order dated 29.11.2024 for filing of status report. Repeated delays and lack of compliance without justified cause from official agencies cannot be accepted as a ground to bypass judicial directions. Inquiry Officer SI Piyush Tomar is absent today without any intimation or sufficient cause. In the circumstances, this court is constrained to initiate coercive steps. Let bailable warrant in the sum of 10,000/- with one ₹ surety of like amount be issued against Inquiry Officer SI Piyush Tomar, returnable for the next date of hearing, to be executed through the SHO concerned. -- 1 of 2 -- One last and final opportunity is granted to the SHO concerned to comply with the order dated 22.08.2024 and also file an explanation in writing as to: 1. Why the earlier orders of the court have not been complied with; and 2. Why the documents, including the present request, were not routed through his office.
