Present: Ms. Vaishali, Ld. Counsel for the complainant through VC.
Complainant in person.
None for accused.
It is submitted by the complainant that matter was settled for an
amount of Rs. 3,50,000/- which had to be completed by June 2025. He further
submits that he has received only Rs. 2 lac till today. The last amount was
received in December 2024.
Perusal of record shows that cheque in question is of Rs. 3,25,000/-,
mediation report is not on record to confirm the factum of settlement for an
amount of Rs. 3,50,000/-. Considering the same, the complainant is directed to
file copy of settlement.
Let bailable warrants in the sum of Rs. 10,000/-, be issued against
the accused, with one surety of like amount, through the SHO concerned, on
filing of PF within 2 months, returnable on NDOH.
Accused is given one more opportunity to comply with settlement.
BWs to carry an endorsement that the accused is directed to
make the full and final payment out of the settlement.
Be put up for verification of payment/ appearance of accused/
framing of notice/ furnishing of surety/ further proceedings on 11.12.2025.
