Ayush Khetarpal, Ld. counsel for the Financial Institution with AR of the Financial Institution in person. Court Receiver Sh. Nishat Ahmed is present via VC. Ld. Counsel for the Financial Institution has informed this court that the physical possession of the secured asset has not been taken as the borrower had paid the amount due and the account had been regularized. He has informed the court that the amount of Rs.7,500/- had been paid to the Ld. Court Receiver in terms of the order dt.10.06.2026. He submits that the remaining amount was not paid as the same was to be paid after the possession of the secured asset was taken and delivered to the Financial Institution. The Ld. Court Receiver, however, presses that the entire amount of Rs.15,000/- ought to have been paid to him as he had expended a considerable amount in pasting the notice. This Court is however, not inclined to direct the payment of the remaining amount as it was contingent on the taking of the physical possession of the secured asset. The prayer of the Court Receiver is accordingly, dismissed. Proceedings stand completed. File be consigned to the Record Room after due compliance. Copy of this order be given dasti to the Ld.
