Notice u/s 251 Cr. P.C. framed against the accused for
the offence u/s 138 NI Act to which he has pleaded not guilty and
claimed trial.
Admission/ denial of documents done u/s 294 Cr.
P.C.In view of the admission of the accused of his signature on the
cheque, bank return memo and the address appearing on the legal
demand notice, witnesses cited in list of witnesses by complainant at
serial no. 2 and 3 stand dropped from said list.
Considering the defense taken by accused as triable
issues have been raised and it is essential that the version of
complainant is subjected to the rigorous of the cross-examination
for eliciting the truth, therefore, accused is granted opportunity to
cross-examine the complainant u/s 145(2) NI Act.
Further, this Court does not deem it desirable /
appropriate to try the case summarily since sentence for
imprisonment exceeding one year may have to be passed if trial
results in conviction.
Hence, this case would be tried as summons trial case.
List the matter for CE on 15.05.2026.
