for the complainant.
Sh. Harsha, Ld. Counsel for the proposed accused along with
proposed accused (through VC).
Matter is at the stage of consideration on present complaint.
Ld. Counsel for the complainant submits that no efforts for
settlement has been made by proposed accused.
Ld. Counsel for the proposed accused submits that payment has
bene made for the entire loan amount. However, no proof has been filed.
In absence of any proof, the matter has to be proceeded with as
the submissions are matter of trial. Opportunity u/s 223 First Proviso BNSS,
2023 stands closed.
Complaint perused. Cognizance taken.
Perusal of file reveals that cheque(s) got presented for
encashment and got returned dishonoured. Accused has failed to make payment
within the statutory period despite a legal notice of demand. The Complaint is
within the territorial jurisdiction of this Court and is within limitation. Enquiry
under Section 202 CrPC conducted by scrutinizing documents. Arguments on
summoning heard.
In view of submissions, issue summons to accused Babu
Ramarao.
Requirement of sending summons is dispensed with in view of
the presence of the accused.
Counsel holding vakalatnama for accused and accused are
directed to remain physically present in court on NDOH for procuring bail /
framing of notice on 21.01.2026.
