Today, undersigned is also working as Link JMFC to Ld. JMFC NI-03.
Present: Sh. Kautilya Kaushik, Ld. Counsel for complainant (through VC).
None for accused.
NBWs issued against the accused received back unexecuted with the
report that mother of accused Rajesh was found who stated that accused is not
coming at home and has no information about his whereabouts. Two other witnesses
who are the neighbors of the accused namely Nikhil and Yogender were found who
also deposed on the same lines. Statement of all the witnesses have been annexed.
PREVIOUSLY, BWS WERE RECEIVED BACK EXECUTED.
LD. COUNSEL FOR COMPLAINANT SEEKS TIME TO FILE
FRESH EVIDENCE AFFIDAVIT OF THE SUBSTITUTED AR. Copy be sent to
opposite side atleast 7 days prior to NDOH.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused through the concerned DCP
returnable on NDOH, on filing of PF within two months. DCP concerned is directed
to ensure atleast three visits/ attempts are made to execute the process and proper
report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant on the no. 7895348627, in view of the judgment passed by Hon’ble
Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr.,
2025 (SC)

Put up for filing of fresh evidence affidavit/ appearance of accused/
framing of notice/ furnishing of surety/ further proceedings on 05.07.2027.
