Order Details: COPY OF ORDER Pdf Text: 35 CC NI ACT 7472/2023 RAJESH KAKKAR SONS HUF Vs. NIDHI 13.08.2025 Reader of this court is on leave today. Present: Sh. Subhash Chandra, Ld. Counsel for the complainant with complainant. Accused no. 1 Nidhi proprietor. Accused no. 2 Saurabh (signatory of proprietorship). Both accused are absent. Sh. Manish Kumar, Proxy counsel for both accused. Surety bonds have not been furnished by accused no. 1 & 2 till today. However, inadvertently, on last date of hearing, it was mentioned that accused no. 1 has furnished the surety bonds. However, no such bonds are on record. Cost of Rs. 2,000/- imposed upon accused no. 2 to be paid to the complainant has not been paid till today. Accused is directed to pay the said cost within 10 days from today on mobile number 9971432741. An application has been moved on behalf of accused no.1 & 2 for exemption from personal appearance stating that their relative has expired. Same has been objected by counsel for complainant. Same is considered and allowed for today only Matter is listed today for CE. However, main counsel for accused is stated to be not available today. Accordingly, matter is adjourned subject to cost of Rs. 500/- in total to be paid to NGO for rescuing animals namely “Karanpuri Foundation through MILAAP Link”. Receipt of same be filed on NDOH. One more opportunity is granted to the accused to cross examine the complainant on next date of hearing. Payment of cost shall be pre-requisite for cross-examination.
