Fresh case received by way of assignment. It be checked and registered as per
rules.
Present: Ms Chanchal, Ld counsel for the complainant through VC.
This is a fresh case.
In the light of recent judgment of Hon’ble Supreme Court of India in “Sanjabij
Tari v. Kishore S. Borcar & Anr., 2025 LiveLaw (SC) 952”, there shall be no requirement to
issue summons to the accused in terms of Section 223 of BNSS i.e., at the pre-cognizance stage.
Hence, appearance of proposed accused is hereby dispensed with.
Ld counsel for the complainant submits that there is delay in filing of the present
case and an application for condonation of delay has been filed in this regard.
Submissions heard. Record perused.
Let notice of aforesaid application be issued to the proposed accused on filing of
PF/RC/AD for the NDOH. Service be also affected dasti as well as on the email, WhatsApp
message(s) and text message of proposed accused person(s), as provided by the complainant and
further subject to filing of affidavit of service. PF be filed within one month.
Be put up for further proceedings on 14.10.2026.
