Present: Sh. B. K. Jain, AR of complainant in person.
Sh. Shobhit Basoya, Legal Executive on behalf of complainant.
None for accused.
This is a transferred matter from Digital Court-01. Physical file has
been received. Complainant has FILED all the previous order sheets.
Perusal shows that matter is at THE STAGE OF APPEARANCE OF
ACCUSED AND NBWS WERE ISSUED AGAINST HIM. Accused has already
entered appearance in the present matter.
NOTICE HAS NOT BEEN FRAMED IN THE PRESENT MATTER.
Today, an application has been filed for substitution of AR by the
complainant. Same is taken on record. Application being formal in nature is allowed
and accordingly Mr. B. K. Jain stands substituted as AR of the complainant.
AR of the complainant submits that accused has failed to settle the
matter despite seeking time. Today also, he has failed to appear. Accordingly, the
matter is being proceeded on merits.
Seeing this conduct of the accused, cost of Rs. 1,000/- is imposed on
the accused to be paid to NGO “AB SEVA FOUNDATION SANSTHAN” on the
UPI no. 8529243603. Receipt of same be filed by NDOH.
PAYMENT OF COST IS PRE REQUISITE.
NBWs issued against the accused received back unexecuted through
DCP concerned with the report that no information of the accused could be found.
Report along with photographs have been annexed.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let process U/s 84 BNSS be issued against
the accused through the concerned SHO. It is made clear that same be executed
within a gap of 30 days prior to the next date of hearing.
The process shall contain directions to the process server to appear in
person alongwith the compliance report on the next date of hearing.
Accused has already entered appearance in the present matter.
Publication be also made in local newspaper.
Put up for report of process server and recording of his statement on
04.08.2027.
