Present: Sh. Surender Kumar, AR of complainant in person.
Sh. Satyendra Kumar and Sh. Shobhit Basoya, Ld. Counsels for
complainant.
None for accused.
NBWs issued against the accused received back unexecuted with the
report that accused was not found at the given address. Thereafter, accused was
contacted over his phone who stated that he is not related with the case.
Warrants shows that the address mentioned on it is different as on
memo of parties.
Previously accused had entered appearance.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused on the address mentioned on
the memo of parties, through the concerned DCP returnable on NDOH, on filing of
PF within two months. DCP concerned is directed to ensure atleast three visits/
attempts are made to execute the process and proper report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 07.10.2026.
