Matters are being taken up physically in terms of order no. 67/RG/DHC/2022 dated 11.02.2022.
VC Link is kept open for appearance in terms of order no. 01/RG/DHC/2023 dated 05.06.2023.
Present : Complainant with Ld. Counsel Sh. Khalid Azeez and Sh. Nafees
Bukhari.
Sh. Paramveer Singh, D/1183/2011, ld. Counsel for the accused
through VC.
Accused absent.
Summons issued received back unexecuted.
However, counsel for accused entered appearance through VC. He
submits that he shall file the vakalatnama on behalf of accused by the end of the
day.
Further, since the summons have remained unexecuted, query is
made to the counsel qua the address of the accused.
Counsel for accused submits that as per instructions received, the
current address of accused is H. No. 27, Raj Nagar, Pitampura, North West
Delhi and phone number is 9811208206.
However, perusal of record shows that attempts were made to serve
the summons at the said address on 03.02.2024, 05.02.2024 and 06.02.2024.
However, the occupant refused to accept the summons.
Counsel for accused submits that the accused is presently at abroad
and as per instructions received, the aforesaid address is the correct address of
accused.
Therefore, the aforesaid address is taken as the current
address of accused.
Further, counsel for accused orally seeks exemption stating that he
is moving transfer petition before the Ld. CMM since multiple cases between the
same parties are pending before the different courts.
On query, he submits that no stay has been granted.
Therefore, subject to appearance of accused on NDOH, exemption
is allowed only for today.
Further, since the accused refused to accept the summons and
the copy of the complaint alongwith the documents have returned back to
the Court, accused is at liberty to take the same from the court file against
acknowledgment before the Ahlmad concerned.
List the matter for notice/ bail on 13.11.2024.
