Present: Sh. Gaurav, Ld. Proxy Counsel for complainant.
None for accused proprietor.
Ld. Counsel for complainant seeks time to file his vakalatnama as he
has been recently assigned with the case.
NBWs issued against the accused received back unexecuted through
DCP concerned with the report that on all the visits accused was not found but his
family members were present. Father of accused Satyaveer was found who stated
that accused has gone to Maharashtra since past 15 days and he has no information
about when he shall return. Thereafter, neighbour of the accused namely Rajkumar
and Sumit were found who stated that accused is their uncle and they will inform
accused about NDOH and also brother of accused Kapil was found who told that
accused is not at home since 10-12 days. Statement of all the witnesses are annexed.
Previously, BWs were received back executed upon accused.
NOTICE HAS NOT BEEN FRAMED IN THE PRESENT MATTER.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let process U/s 84 BNSS be issued against
the accused through the concerned SHO. It is made clear that same be executed
within a gap of 30 days prior to the next date of hearing.
The process shall contain directions to the process server to appear in
person alongwith the compliance report on the next date of hearing.
Publication be also made in local newspaper.
Put up for report of process server and recording of his statement on
25.05.2027.
