Notice u/s 251 Cr.P.C. has been framed against the accused. Plea
of defence recorded.
It has been submitted by Ld. counsel for accused that he wants to
cross examine the complainant on the specific points as have come on record in
the defence disclosed by accused today. Ld. Counsel for the complainant has no

objection to the same. Accordingly, the requirement of filing formal application
u/ s 145 (2) NI Act stands dispensed with.
The present trial, if results in conviction, might entail grant of
imprisonment of more than one year. Hence, the court deems it fit that the
present case be tried as a summons case. From now onwards, this matter shall be
proceeded further like trial of a summons case.
Admission denial of documents conducted u/s 294 Cr.P.C. in
view of the same, witnesses mentioned at S.No. 2, 3, 4 and 5 of list of witnesses
filed by the complainant are hereby dropped.
