Present:- None for complainant.
Sh. Virendra Singh, Ld. Counsel for accused alongwith the
accused in person.
Matter is at the stage of bail of accused and framing of notice.
Ld. Counsel for accused prays that the accused be admitted to
bail in the present case. Accused is admitted to bail on furnishing of bail bonds
in the sum of Rs. 25,000/- with one surety in the like amount. Some time is
sought on behalf of accused to furnish bail bonds. Same be done on NDOH.
Notice under Section 251 Cr.P.C. has been framed upon the
accused. Her plea of defence has been recorded. Accused has pleaded not
guilty and claimed trial. She has pressed for cross-examination of
complainant/AR under Section 145(2) NI Act.
In view of plea of defence of accused, probable defence has been
raised and accused is granted opportunity to cross-examine the
complainant/AR. Considering the circumstances, the present matter is being
tried as a summons case instead of summarily, in terms of second proviso to
Section 143(1) NI Act.
In terms of admission/denial of the documents recorded under
Section 294 Cr.P.C., witness at sr. no. 2 is hereby dropped from list of
witnesses. Last and final opportunity is granted to complainant to pursue the
present case.
