None for accused.
BWs issued against the accused received back unexecuted on the
address of Sector 2, Ghaziabad, with the report that address of the accused could not
be traced and no information of the accused could be found. Photographs is annexed.
AN AFFIDAVIT OF VERIFICATION OF ADDRESS OF ACCUSED
SITUATED AT SECTOR 2 GHAZIABAD HAS ALREADY BEEN FILED BY THE
COMPLAINANT ON LDOH.
Complainant side submits that no other address of the accused is
traceable.
Service was never effected upon accused. However, considering the
affidavit filed by the complainant, matter is being proceeded.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let NBWs be issued against the accused on
the address of Sector-2, Ghaziabad, through the concerned SHO, on filing of PF
within two months, returnable on NDOH.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant on the no. 9891126184, in view of the judgment passed by Hon’ble
Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr.,
2025 (SC)

Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 20.08.2027.
