Mr. Saurav Kumar Dixit, Ld. Counsel for accused No.3. Accused no. 1 is company. Accused No.2 is absent. Accused No.3 in person. Matter is at the stage of appearance of accused/furnishing of bail bonds/ framing of notice. NBWs issued against the accused No.2 received back unexecuted with the report that the accused is not present at the address since last 1.5 to 2 years. The other address could not be reached in time. Perusal of record reveals that at the time of execution of B.Ws, the accused No.2 was contacted on a phone call and was apprised about the court order. It appears that the accused No.2 has knowledge of the present proceedings and that the accused No.2 is deliberately avoiding the proceedings of court and arrest. Be awaited for the appearance of accused No.2 till 02:00 PM. Since the offence is bailable, the accused No.3 is granted bail, subject to furnishing of bail bonds in the sum of Rs. 30,000/- with one surety in the like amount. Personal bonds and surety bonds are furnished by the accused No.3. Same are accepted. Original RC seen and returned. Copy of the same retained on record. Intimation be sent to transport department. Notice under Sec. 274 BNSS has been framed against the accused No.3 to which they pleaded not guilty and claimed trial. Plea of defence has been separately Steno Purshotam Kumar, Emp. Code 99617087 -- 1 of 2 -- recorded and explained to the accused. Statement of accused No.3 under Section 330 BNSS also recorded. Considering the defence taken by the accused in their statement under Sec. 274 BNSS, a plausible defence has been taken by the accused for which an opportunity for cross examination of the complainant is fit to be given to the accused u/s 145(2) NI Act. Upon oral request of the accused, the filing of application u/s 145(2) NI Act stands dispensed with. The case shall be tried by way of summary trial method.
