Cognizance is yet to be taken in the matter. There is some
doubt regarding the maintainability of the present proceedings/legality
of the investigation undertaken in the matter.
Accordingly, issue notice to SI Gulshan Kumar as well as
Inspector Pradeep Singh (who was the complainant in the present case)
for the NDOH. It be specifically mentioned that no exemption request
shall be entertained and absence shall be viewed adversely.
Ld. APP for the State is requested to go through the case
file, and especially look into the aspect of maintainability of the present
proceedings/legality of investigation, especially in light of the replies
filed by the DCP, as recorded in the orders dated 04.02.2025,
26.07.2025 and 15.09.2025.

Also issue notice to the Drug Inspector for the NDOH i.e.
04.07.2026. Accused persons to remain present in person with their
respective counsels.
