Matter is listed today for consideration on the point of
cognizance.
It is submitted by the ld. APP for the State that in present
matter appropriate provision of Drug and Cosmetics Act have not
been invoked despite the fact that offence (s) under the said Act are
made out. It is further submitted that offence under the said Act is
triable by a Special Court.
Put up for consideration on the point of cognizance/
consideration on the aspect of offence (s) under Drug and Cosmetic
Act / further proceedings on 27.06.2024.
Let DCP concerned be summoned for NDOH for
explaining as to why no investigation was conducted regarding Drug
and Cosmetic Act which is stated to be made out in the present case.
Let copy of this order be annexed alongwith the process.
IO concerned is bound down for NDOH.
