Today undersigned is also working as second half Link of Ld. JMFC NI Act-03 and
full day Link of Ld. JMFC NI Act-02.
Reader of this court is on leave today.
Present: Sh. M. M. Kumar, Ld. Counsel for complainant.
None for accused proprietor.
BWs issued against the accused received back with the report that
daughter of accused Preeti was found who stated that the accused no longer comes
to the house and resides in Amethi, UP. She further submitted that the proprietorship
firms of accused has been closed since 4-5 years. Separate statement of Preeti has
also been annexed. Thereafter, on contacting on the phone no. of the accused, his
phone (9820049365) was switched off. On the address of UP that was given by
Preeti i.e. Flat No. 1503 ASPEN Building, UP the address of the accused was found
locked.
Perusal further shows that there was reply by the accused to the legal
demand notice sent by the complainant on the addresses on record.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let NBWs be issued against the accused
proprietor through the concerned SHO on all the addresses including the address of
UP as mentioned above on filing of PF within two months, returnable on NDOH.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 25.03.2026.
