Present: Sh. Subhash Chandra, Ld. Counsel for complainant.
None for accused proprietor.
NBWs issued against the accused through DCP concerned received
back unexecuted with the report that on 1 visit address was found locked, thereafter
father of accused Gangaram was found who stated that the accused has gone to
Chandigarh and seldom comes home. On the 2nd visit also, address was found
locked. On the 3rd visit, a the address of Govind Sagar Dhaba, one person Sunil was
found who stated that since many days, accused has not appeared. Detailed report
along with all the entries, photographs and statement of 3 witnesses is annexed.
Previously also father of accused was found who has given similar
statements.
Notice has not been framed in the present matter.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let process U/s 84 BNSS be issued against
the accused through the concerned SHO. It is made clear that same be executed
within a gap of 30 days prior to the next date of hearing.
The process shall contain directions to the process server to appear in
person alongwith the compliance report on the next date of hearing.
Publication be also made in local newspaper.
Put up for report of process server and recording of his statement on
10.07.2026.
