None for accused.
Fresh Vakalatnama filed on behalf of complainant. Taken on record.
NBWs issued against the accused received back unexecuted with the
report that son of accused Harvinder was found who stated that accused has gone out
of station. Statement is annexed.
Previously BWs were received back executed but accused had failed to
appear. Today also, accused has failed to appear.
Seeing this conduct of the accused, cost of Rs. 1,000/- to be paid to
NGO on the UPI id: earthlingstrust99.rzp@icici. Receipt of same be filed by
NDOH.
PAYMENT OF COST IS PRE REQUISITE.
Accordingly, it is inferred that accused is deliberately avoiding
appearance before this court.
Let NBWs be issued against the accused through the concerned DCP
returnable on NDOH, on filing of PF within two months. DCP concerned is directed
to ensure atleast three visits/ attempts are made to execute the process and proper
report be filed.
Copy of this order be sent to DCP concerned to ensure compliance.
Warrants should carry an endorsement that accused is at liberty to
settle the matter and pay the amount to the complainant by reaching out the
complainant side on the no. 8603600762, in view of the judgment passed by
Hon’ble Supreme Court of India, in case titled as
Sanjabij Tari Vs. Kishore S.
Borcar & Anr., 2025 (SC)

Put up for appearance of accused/ framing of notice/ furnishing of
