Present: Sh. Virender Singh, Ld. Counsel for complainant.
Accused proprietor (through VC).
Sh. Sumit Gaur, Ld. Counsel for accused (through VC).
Perusal shows that cheque in question is drawn in the name of firm,
however, accused T Murugesan submits that he was the proprietor of the said firm.
Ld. Counsel for accused submits that he has made the entire payment
of the cheque amount. Same has been disputed by Ld. Counsel for complainant. He
is directed to supply the payment proofs to the complainant for verification.
Due to the discrepancy in payment verification, the court is
constrained to proceed the matter on merits.
Accused has failed to appear in person despite directions on LDOH.
Previously also, NBWs were issued against the accused. Repeatedly, accused has
failed to appear in person.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let NBWs be issued against the accused
through the concerned SHO, on filing of PF within two months, returnable on
NDOH.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 05.02.2027.
